Guest
Determination No. A-2019-12 January 30, 2019 APPLICATION by Flair Airlines Ltd. (Flair), on behalf of itself and Travel Service, a.s. (Travel Service), pursuant to section 60 of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA), and section 8.2 of the Air Transportation Regulations, SOR/88-58, as amended (ATR). Case number: 19-00313 APPLICATION Flair, on behalf of itself and Travel Service, has applied to the Canadian Transportation Agency (Agency) for an approval to permit Flair to provide its scheduled international service between Canada and the United States of America using one aircraft with flight crew provided by Travel Service, beginning on January 31, 2019 to April 30, 2019. Flair is licensed to operate a scheduled international service in accordance with the Air Transport Agreement between the Government of Canada and the Government of the United States of America signed on March 12, 2007. In its application filed on January 21, 2019, Flair states that it had seven aircraft on its Air Operator Certificate (AOC) at the time of application. Flair has also requested an exemption from the application of subsection 8.2(2) of the ATR, which requires the filing of an application for an approval at least 45 days before the first planned flight. The Agency finds that compliance with subsection 8.2(2) of the ATR is impractical in this case. Accordingly, the Agency, pursuant to paragraph 80(1)(c) of the CTA, exempts Flair from the application of subsection 8.2(2) of the ATR. POLICY When assessing wet-lease applications where Canadian carriers propose to enter into wet lease arrangements of more than 30 days with foreign carriers to provide international passenger services, the Agency must apply a direction issued by the Minister of Transport on June 24, 2014 entitled Ministerial Direction for International Service – Canada's Policy for Wet-Leasing (2014 Wet Lease Policy), and must specifically ensure that the 20-percent cap is respected at the time of application. The 2014 Wet-Lease Policy also states that the Agency should condition or deny an application if Canadian air carriers do not enjoy reciprocal opportunities to wet lease in the foreign jurisdiction of the lessor. ISSUE Is the Agency satisfied that the application of Flair meets the requirements of section 8.2 of the ATR and the criteria of the 2014 Wet Lease Policy, specifically the 20 percent cap? ANALYSIS AND FINDINGS Section 60 of the CTA requires that a licensee obtain, where prescribed, an approval from the Agency prior to using aircraft with flight crew provided by another person. Section 8.2 of the ATR sets out the information to be included in an application and the requirements to be met for an approval pursuant to section 60 of the CTA. Pursuant to the 2014 Wet-Lease Policy, for wet-leases of more than 30 days, a number of aircraft equal to 20 percent of the number of Canadian-registered aircraft on the lessee's AOC may be wet leased from foreign lessors. The Agency notes that at the time of the application, on January 21, 2019, Flair had seven aircraft on its AOC. Therefore, the application of Flair meets the 20 percent cap requirement of the 2014 Wet Lease Policy. The Agency has considered the application and the material in support and is satisfied that it meets the remaining requirements of section 8.2 of the ATR. Accordingly, the Agency, pursuant to paragraph 60(1)(b) of the CTA and section 8.2 of the ATR, approves the use by Flair of one aircraft with flight crew provided by Travel Service, and the provision by Travel Service of such aircraft and flight crew to Flair, to permit Flair to provide its scheduled international service on licensed routes between Canada and the United States of America using one aircraft and flight crew provided by Travel Service, beginning on January 31, 2019 to April 30, 2019. This approval is subject to the following conditions: Flair shall continue to hold the valid licence authority. Commercial control of the flights shall be maintained by Flair. Travel Service shall maintain operational control of the flights and shall receive payment based on the rental of aircraft and crew and not on the basis of the volume of traffic carried or other revenue-sharing formula. Flair and Travel Service shall continue to comply with the insurance requirements set out in subsections 8.2(4), 8.2(5) and 8.2(6) of the ATR. Flair shall continue to comply with the public disclosure requirements set out in section 8.5 of the ATR. Flair and Travel Service shall advise the Agency in advance of any changes to the information provided in support of the application. Member(s) J. Guest
Flair Airlines warns customers to beware of fraudsters impersonating its website News provided by the Vancouver Sun – link to full story and updates Fake sites ask customers to call a toll-free number to complete transactions COLIN MCCLELLAND January 3, 2020 Flair Airlines says it has become aware of false sites requesting potential passengers to call into a toll-free number to complete transactions. FLAIR AIRLINES Canadian budget carrier Flair Airlines Ltd. issued a fraud warning Friday saying customers should beware of fake websites impersonating its employees and services. Kelowna, B.C.-based Flair said it has become aware of false sites requesting potential passengers to call into a toll-free number to complete transactions, which Flair does not do. “Should a window appear with a phone number to call please be advised you may be experiencing fraud,” the carrier said in a statement. It said the correct URL of its website is www.flyflair.com and its only customer service number is 1-780-809-1784. It recommends that if customers are uncertain they should hang up and call its customer service line directly. “Flair does not stand for fraud and is working closely with the RCMP to investigate and rectify this issue as soon as possible,” the company said in a statement. “If you feel you have been a victim of fraud, please contact your local police.” So far, it appears no one’s actually been swindled by the imposter websites, which the airline says appears to be based outside of Canada. Canadians lost around $100 million to fraud in 2017, according to the Competition Bureau Canada. Flair Airlines operated as a charter carrier for more than a decade before transitioning to fully scheduled service in June, 2017. The airline uses Edmonton as its main hub offering 120 flights a week across the country that it claims undercut market prices by as much as 40 per cent. Its destinations include Abbotsford, B.C., Vancouver, Kelowna, Edmonton, Calgary, Winnipeg and Toronto’s Pearson International. The airline competes domestically in the discount or ultra-low-fare space with Air Canada’s subsidiary Rouge, Westjet Airline Ltd.’s Swoop and the beleaguered Canada Jetlines Ltd., which has been trying to get off the ground since 2012 and recently signed a letter of intent to merge with Delaware-based Global Crossing Airlines and add U.S. vacation destinations to its plans. Ultra-low-cost airlines are betting that customers will place cheap fares above other considerations, but they have to contend with a large and sparsely populated country that makes travel expensive. And their small fleets mean unexpected disruptions can have a whopping impact on their schedules. For instance, the grounding of Boeing’s 737 Max planes may not have affected some of them directly, but it has sent their parent airlines such as Air Canada and WestJet scrambling to meet demand, withdrawing plane options that could otherwise be lent to subsidiaries when they encounter problems. And when customers are sidelined by maintenance issues and have to rebook on a main carrier, they may incur huge fares when booking last minute. Flair is phasing out its older Boeing 737-400 aircraft by adding newer Boeing 737-800s in a fleet renewal program it says will increase efficiency and punctuality. New destinations will include Ottawa, ON; Saint John, NB, Charlottetown, PEI; as well as a returning service to Halifax, NS. Provided by Jaci Stevens (c) 2020 Sarah Riches, Director of Commercial for Flair Airlines states: “Our Mission is to make air travel accessible, affordable and desirable for all. Eastern and Atlantic Canada have long been plagued by high airfares and undesirable service. Simply put, they have been paying too much for too little and we believe its time for change.” Jim Scott, CEO of Flair Airlines reports, “We are committed to connecting more Canadians with their families and friends across the country. Our expanded routes into Ottawa and the Atlantic Maritimes are exciting and displays the need Canadians have for affordable air travel. Having flown nearly one million passengers in 2019 and with plans to fly 1.5 million in 2020, we are proud to be expanding our reach further across the country.” Passengers aren’t the only ones excited for Flair to start service in their hometowns. Airports were also quick to welcome and offer their support. “Airlines like Flair have changed the aviation landscape worldwide by delivering lower-cost unbundled fares” said Mark Laroche, President and CEO of the Ottawa International Airport Authority. “Every passenger has the choice to pay for the options they value, such as seat assignments, checked bags, as well as in-flight food and beverage. Flair Airlines is a welcome addition to YOW’s offering.” Saint John Airport President and CEO, Derrick Stanford, expressed similar excitement. “We’re delighted that Flair Airlines has selected Saint John as their exclusive New Brunswick destination. We’re dedicated to finding Saint John travellers the best possible value and options, and with Flair’s unique pricing model almost anyone can afford to fly.” At the heart of Flair’s new markets is a commitment to support local communities and businesses. From promoting tourism to placing local food and beverage product on board, Flair strives to contribute to the economic growth of the communities it serves. “It’s exciting to see Flair return to Halifax Stanfield this summer, providing our passengers with even more choice for travel between Ontario and Nova Scotia,” said Joyce Carter, President & CEO, Halifax International Airport Authority. “The addition of Ottawa as a second destination will complement Flair’s service between Halifax and the Toronto area over the past two years. We know their service offering is appealing to people of all ages and provides a stronger connection between our communities, driving inbound tourism and economic growth – it’s a real win-win.” Adding Charlottetown to Flair’s route network has also sparked excitement and encouragement. “We are pleased to welcome Flair Airlines as our newest airline partner to Charlottetown,” said Doug Newson, CEO at Charlottetown Airport Authority. “Flair has impressively grown their fleet and route network since their launch in 2017, and we are excited to be a part of this latest expansion into Atlantic Canada.” In addition to their new Atlantic routes, Flair has also relaunched service between Calgary and Kelowna, a route that passengers voiced their interest in heavily. To celebrate their new summer schedule and destinations, Flair is offering introductory one-way fares between Toronto and Ottawa starting as low as $59 and fares between Toronto and Saint John for as little as $79 including all taxes and fees (limited seats available for a limited time). Guest
Flair Airlines Announces New Summer Schedule 3 June 2020Canadian Aviation News From Flair Airlines Bringing affordable, friendly, and reliable service to Canadians. Flair makes it their mission to provide service when the time is right. Edmonton, Alberta, June 03, 2020 (GLOBE NEWSWIRE) — Flair Airlines announces a return to Kelowna and Winnipeg, while making the difficult decision to delay the launch of certain locations as a result of travel restrictions related to the global pandemic. Flair is thrilled to announce an expansion of their current route schedule which includes service to Toronto, Edmonton, Calgary, and Vancouver with a much-anticipated return to Kelowna and Winnipeg. Carrying out a mission to bring affordable, friendly, and reliable air travel to Canadians while balancing the impact of a global pandemic has not come without difficult decisions. As a result, Flair will be delaying the launch of service into Ottawa and Atlantic Canada. In the face of adversity, Flair has decided to stand out as a leader in the industry and offer full refunds for passengers booked on cancelled flights to the affected destinations – Ottawa, Halifax, Saint John, N.B and Charlottetown. “Due to the current provincial travel restrictions and quarantine requirements, we feel this is the best balance right now for both the provinces, and for Flair as a business,” says John Mullins, Vice President of Customer Experience and Airports. “Safety comes first for Flair and our customers are our priority.” Based on feedback received from Canadians in a recent Nanos Research survey, Flair knows there is a need for choice and affordable air travel in Canada. Atlantic Canada remains a priority region for Flair and the company will look to return to these destinations soon. When Flair does return to these markets, it will remain committed to stimulate the local economies by increasing tourism to the areas as well as sourcing local products and vendors. “This is only temporary,” added Mr. Mullins. “Flair is proud to bring Canadians affordable and friendly air travel and we look forward to providing more choice to our customers for their travel needs. We will be there for Ottawa and Atlantic Canada as soon as everyone is ready for our arrival.” Passengers already booked on flights to the affected destinations will be contacted through email with instructions on how to receive refunds, further proof that Flair is a different kind of airline than its larger competitors. If customers require support, they are asked to contact Flair at 1-800-441-7214. Information on affected flights can also be found at https://flyflair.com/rerouting-passengers. Mr. Jones replaces Jim Scott, the outgoing President and CEO, who presided over the year-long process to identify his successor. After nearly three years, Mr. Scott has decided to retire as Flair’s President and CEO. He will remain as a shareholder of the company. Mr. Jones, former Managing Director and Deputy Chief Executive Officer of Wizz Air, was selected as CEO and President after an extensive global search. During Mr. Jones tenure at Wizz, one of the most profitable and fastest growing ULCC airlines in the world, he was responsible for operating a 110 aircraft fleet while heading the commercial, marketing, supply chain and digital organizations. Before Wizz Air, Mr. Jones served as Air New Zealand’s Chief Strategy Networks and Alliances Officer and was Chairman of the Alliance Management Board for the Star Alliance. A spokesperson for the Flair Board remarked, “Mr. Jones invaluable experience in building and scaling ULCC carriers through a relentless focus on cost will accelerate Flair’s mission to make airfare more egalitarian in Canada. The benefits will accrue first and foremost to the Canadian traveler who has been long neglected. ”As Flair Airlines’ new President and Chief Executive Officer, Mr. Stephen Jones, will lead a dynamic team operating a fleet of Boeing 737-800 aircraft flying to eleven Canadian destinations. I firmly believe that Canadian travellers deserve a better deal. It’s time for the Canadian public to benefit from true competition and the choice that passengers in every other region of the world enjoy. Throughout my career, I have seen the meaningful economic and human impact a ULCC can have on a society; I am privileged to join the Flair team in their mission to do the same in Canada, “said Mr. Jones. Guest1
Free Enterprise at work: Flair Airlines expands with eight new destinations across Canada 10 February 2021Canadian Aviation News ULCC to bring low fare air travel to 18 cities by August, filling voids left by legacy carriers and ensuring affordable travel options are available for Canadians February 10, 2021 06:00 ET | Source: Flair Airlines Edmonton, Alberta, Feb. 10, 2021 (GLOBE NEWSWIRE) — Flair Airlines, Canada’s only independent ultra low-cost carrier (ULCC), is expanding service and will bring low fare air travel to 18 Canadian destinations by summer. Service to four of the new destinations will begin in May with more added in the coming months as non-essential travel within Canada safely restarts. Flair’s ambitious expansion focuses first on growing its domestic network. Flair’s network will expand beginning on May 1st as service is added to Ottawa, ON; Kitchener-Waterloo, ON; Halifax, NS; and Saint John, NB. Flair will add service in June to Thunder Bay, ON; and Charlottetown, PE; in July to Victoria, BC; and in August to Abbotsford, BC. “Canadians have been paying too much for too long, and we are changing that with our ULCC model that makes getting around Canada affordable,” says Stephen Jones, President & CEO. “Providing affordable air travel within Canada is the first step in restarting travel and tourism, and Flair is uniquely positioned with the efficiencies of our low-cost model. When non-essential travel returns, Flair will be there to reconnect families and provide the low fares that have long been denied to Canadians.” Flair anticipates tourism and travel to begin restarting in the Spring and Summer, and the focus on domestic service in 2021 enables the ULCC to provide more low fare options across Canada. “We strongly support the need for restricting non-essential travel as Canada works to bend the curve. Flair was one of the first airlines to reduce our network and focus exclusively on essential domestic travel,” says Jones. “We are confident, as travel returns, there is a strong market for low fare travel choices from a socially responsible Canadian airline. Flair’s ULCC business model doesn’t have the overhead and costs associated with legacy organizations and networks, and this allows our efficiencies to be passed along in our pricing.” Canadian airport partners are excited for Flair’s ULCC service to be coming to their communities: “We’re delighted that Flair Airlines has selected Saint John as their exclusive New Brunswick destination,” says Saint John Airport President and CEO, Derrick Stanford. “We’re dedicated to finding Saint John travellers the best possible value and options, and with Flair’s unique pricing model almost anyone can afford to fly to more places than ever before.” – Derrick Stanford, President & CEO, Saint John Airport “We are pleased to welcome Flair Airlines to the Region of Waterloo International Airport. Once pandemic restrictions are lifted, the addition of Flair’s services will provide further connectivity to other economic hubs, create local jobs, build partnerships and help support the recovery of the local economy.” – Karen Redman, Regional Chair, Region of Waterloo “EIA is proud to be Flair’s home base and it’s exciting to see these growth plans that will benefit our community. We’re confident there’s a bright future for aviation and travel in our market, and low-cost airlines such as Flair are part of that. We will always put the health and safety of passengers and Canadians first, and with our EIA Ready program, we’re committed to a clean and safe travel experience when the time is right.” – Tom Ruth, President & CEO, Edmonton International Airport “Canadians have been separated from their families and friends throughout the pandemic and we are confident there will be demand for a variety of flight options when non-essential air travel resumes. We look forward to welcoming Flair back to Halifax Stanfield, increasing choices for our community members to reconnect when the time is right. With our Stay Healthy measures in place throughout the airport, we’re ready to support passengers on their next journey.” – Joyce Carter, President & CEO, Halifax International Airport Authority Flair is poised to show Canadians the real benefits which other areas of the world have experienced with ULCC service. One-way fares on several of the new routes start as low as $39. In addition, Flair provides complimentary COVID Coverage, allowing passengers to easily change their travel plans given the continued uncertainty caused by the pandemic. Ex 9A Guy
Lots of expansion but it is not like WJ and AC will stay out of these markets when air travel returns to viability. I won't be long before there is overcapacity in many of these markets and then we will see who has the deepest pockets.
