APPLICATION by Flair Airlines Ltd. (Flair), on behalf of itself and Travel Service, a.s. (Travel Service), pursuant to section 60 of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA), and section 8.2 of the Air Transportation Regulations, SOR/88-58, as amended (ATR).

APPLICATION

Flair, on behalf of itself and Travel Service, has applied to the Canadian Transportation Agency (Agency) for an approval to permit Flair to provide its scheduled international service between Canada and the United States of America using one aircraft with flight crew provided by Travel Service, beginning on January 31, 2019 to April 30, 2019.

Flair is licensed to operate a scheduled international service in accordance with the Air Transport Agreement between the Government of Canada and the Government of the United States of America signed on March 12, 2007.

In its application filed on January 21, 2019, Flair states that it had seven aircraft on its Air Operator Certificate (AOC) at the time of application.

Flair has also requested an exemption from the application of subsection 8.2(2) of the ATR, which requires the filing of an application for an approval at least 45 days before the first planned flight. The Agency finds that compliance with subsection 8.2(2) of the ATR is impractical in this case. Accordingly, the Agency, pursuant to paragraph 80(1)(c) of the CTA, exempts Flair from the application of subsection 8.2(2) of the ATR.

POLICY

When assessing wet-lease applications where Canadian carriers propose to enter into wet lease arrangements of more than 30 days with foreign carriers to provide international passenger services, the Agency must apply a direction issued by the Minister of Transport on June 24, 2014 entitled Ministerial Direction for International Service – Canada's Policy for Wet-Leasing (2014 Wet Lease Policy), and must specifically ensure that the 20-percent cap is respected at the time of application. The 2014 Wet-Lease Policy also states that the Agency should condition or deny an application if Canadian air carriers do not enjoy reciprocal opportunities to wet lease in the foreign jurisdiction of the lessor.

ISSUE

Is the Agency satisfied that the application of Flair meets the requirements of section 8.2 of the ATR and the criteria of the 2014 Wet Lease Policy, specifically the 20 percent cap?

ANALYSIS AND FINDINGS

Section 60 of the CTA requires that a licensee obtain, where prescribed, an approval from the Agency prior to using aircraft with flight crew provided by another person.

Section 8.2 of the ATR sets out the information to be included in an application and the requirements to be met for an approval pursuant to section 60 of the CTA.

Pursuant to the 2014 Wet-Lease Policy, for wet-leases of more than 30 days, a number of aircraft equal to 20 percent of the number of Canadian-registered aircraft on the lessee's AOC may be wet leased from foreign lessors. The Agency notes that at the time of the application, on January 21, 2019, Flair had seven aircraft on its AOC. Therefore, the application of Flair meets the 20 percent cap requirement of the 2014 Wet Lease Policy.

The Agency has considered the application and the material in support and is satisfied that it meets the remaining requirements of section 8.2 of the ATR.

Accordingly, the Agency, pursuant to paragraph 60(1)(b) of the CTA and section 8.2 of the ATR, approves the use by Flair of one aircraft with flight crew provided by Travel Service, and the provision by Travel Service of such aircraft and flight crew to Flair, to permit Flair to provide its scheduled international service on licensed routes between Canada and the United States of America using one aircraft and flight crew provided by Travel Service, beginning on January 31, 2019 to April 30, 2019.

This approval is subject to the following conditions:

1. Flair shall continue to hold the valid licence authority.
2. Commercial control of the flights shall be maintained by Flair. Travel Service shall maintain operational control of the flights and shall receive payment based on the rental of aircraft and crew and not on the basis of the volume of traffic carried or other revenue-sharing formula.
3. Flair and Travel Service shall continue to comply with the insurance requirements set out in subsections 8.2(4), 8.2(5) and 8.2(6) of the ATR.
4. Flair shall continue to comply with the public disclosure requirements set out in section 8.5 of the ATR.
5. Flair and Travel Service shall advise the Agency in advance of any changes to the information provided in support of the application.

Canadian budget carrier Flair Airlines Ltd. issued a fraud warning Friday saying customers should beware of fake websites impersonating its employees and services.

Kelowna, B.C.-based Flair said it has become aware of false sites requesting potential passengers to call into a toll-free number to complete transactions, which Flair does not do. “Should a window appear with a phone number to call please be advised you may be experiencing fraud,” the carrier said in a statement.

It said the correct URL of its website is www.flyflair.com and its only customer service number is 1-780-809-1784. It recommends that if customers are uncertain they should hang up and call its customer service line directly.

“Flair does not stand for fraud and is working closely with the RCMP to investigate and rectify this issue as soon as possible,” the company said in a statement. “If you feel you have been a victim of fraud, please contact your local police.”

So far, it appears no one’s actually been swindled by the imposter websites, which the airline says appears to be based outside of Canada. Canadians lost around $100 million to fraud in 2017, according to the Competition Bureau Canada.

Flair Airlines operated as a charter carrier for more than a decade before transitioning to fully scheduled service in June, 2017. The airline uses Edmonton as its main hub offering 120 flights a week across the country that it claims undercut market prices by as much as 40 per cent. Its destinations include Abbotsford, B.C., Vancouver, Kelowna, Edmonton, Calgary, Winnipeg and Toronto’s Pearson International.

The airline competes domestically in the discount or ultra-low-fare space with Air Canada’s subsidiary Rouge, Westjet Airline Ltd.’s Swoop and the beleaguered Canada Jetlines Ltd., which has been trying to get off the ground since 2012 and recently signed a letter of intent to merge with Delaware-based Global Crossing Airlines and add U.S. vacation destinations to its plans.

Ultra-low-cost airlines are betting that customers will place cheap fares above other considerations, but they have to contend with a large and sparsely populated country that makes travel expensive. And their small fleets mean unexpected disruptions can have a whopping impact on their schedules.

For instance, the grounding of Boeing’s 737 Max planes may not have affected some of them directly, but it has sent their parent airlines such as Air Canada and WestJet scrambling to meet demand, withdrawing plane options that could otherwise be lent to subsidiaries when they encounter problems.

And when customers are sidelined by maintenance issues and have to rebook on a main carrier, they may incur huge fares when booking last minute.

Flair is phasing out its older Boeing 737-400 aircraft by adding newer Boeing 737-800s in a fleet renewal program it says will increase efficiency and punctuality.

Flair Airlines announces new Chief Executive Officer – Stephen Jones

Edmonton, Alberta, 13 October 2020 – Flair Airlines is pleased to announce the appointment of Stephen Jones as President and Chief Executive Officer. Mr. Jones replaces Jim Scott, the outgoing President and CEO, who presided over the year-long process to identify his successor.

After nearly three years, Mr. Scott has decided to retire as Flair’s President and CEO.  He will remain as a shareholder of the company.

Mr. Jones, former Managing Director and Deputy Chief Executive Officer of Wizz Air, was selected as CEO and President after an extensive global search. During Mr. Jones tenure at Wizz, one of the most profitable and fastest growing ULCC airlines in the world, he was responsible for operating a 110 aircraft fleet while heading the commercial, marketing, supply chain and digital organizations.  Before Wizz Air, Mr. Jones served as Air New Zealand’s Chief Strategy Networks and Alliances Officer and was Chairman of the Alliance Management Board for the Star Alliance.

Edmonton, Alberta, Feb. 10, 2021 (GLOBE NEWSWIRE) — Flair Airlines, Canada’s only independent ultra low-cost carrier (ULCC), is expanding service and will bring low fare air travel to 18 Canadian destinations by summer. Service to four of the new destinations will begin in May with more added in the coming months as non-essential travel within Canada safely restarts.

Flair’s ambitious expansion focuses first on growing its domestic network. Flair’s network will expand beginning on May 1^st as service is added to Ottawa, ON; Kitchener-Waterloo, ON; Halifax, NS; and Saint John, NB. Flair will add service in June to Thunder Bay, ON; and Charlottetown, PE; in July to Victoria, BC; and in August to Abbotsford, BC.

“Canadians have been paying too much for too long, and we are changing that with our ULCC model that makes getting around Canada affordable,” says Stephen Jones, President & CEO. “Providing affordable air travel within Canada is the first step in restarting travel and tourism, and Flair is uniquely positioned with the efficiencies of our low-cost model. When non-essential travel returns, Flair will be there to reconnect families and provide the low fares that have long been denied to Canadians.”

Flair anticipates tourism and travel to begin restarting in the Spring and Summer, and the focus on domestic service in 2021 enables the ULCC to provide more low fare options across Canada.

“We strongly support the need for restricting non-essential travel as Canada works to bend the curve. Flair was one of the first airlines to reduce our network and focus exclusively on essential domestic travel,” says Jones. “We are confident, as travel returns, there is a strong market for low fare travel choices from a socially responsible Canadian airline. Flair’s ULCC business model doesn’t have the overhead and costs associated with legacy organizations and networks, and this allows our efficiencies to be passed along in our pricing.”

Lots of expansion but it is not like WJ and AC will stay out of these markets when air travel returns to viability.  I won't be long before there is overcapacity in many of these markets and then we will see who has the deepest pockets.
