(Y) Decision No. 521-A-2003 September 12, 2003 APPLICATION by Air Canada pursuant to section 77 of the Canada Transportation Act, S.C., 1996, c. 10, for authority to operate one additional round-trip flight per week between Toronto, Ontario, Canada and Sao Paulo, Brazil during the period from September 15, 2003 to March 27, 2004. File No. M4210/A74-4-45 Docket No. 031131AG -------------------------------------------------------------------------------- Air Canada has applied to the Canadian Transportation Agency (hereinafter the Agency) for the authority set out in the title. The application was received on September 10, 2003. Air Canada submits that the additional flights are required to meet increased consumer demand for travel. Under Licence No. 000143, Air Canada is authorized to operate a scheduled international service, large aircraft, between Canada and Brazil in accordance with the Agreement between the Government of Canada and the Government of the Federative Republic of Brazil on Air Transport signed on May 15, 1986, as amended (hereinafter the Agreement). Under the terms of the Agreement, the aeronautical authorities may approve temporary increases in capacity. By letter dated August 25, 2003, Air Canada advised that it had obtained approval for a seventh weekly flight from the Brazilian aeronautical authorities for the period up to October 6, 2003, and has also requested extension of the approval to the end of the IATA Winter Season, which is March 27, 2004. The Agency has reviewed and considered the application and the material filed in support thereof and is satisfied that a temporary increase in the frequency of air services would benefit consumers. Accordingly, pursuant to section 77 of the Canada Transportation Act and as provided for in the Agreement, the Agency hereby authorizes Air Canada to operate one (1) additional round-trip flight per week between Toronto and Sao Paulo during the period from September 15, 2003 to March 27, 2004. The authorization granted herein does not exempt Air Canada from the requirements of other legislative acts or regulations, including those of Transport Canada.
