It's a shame it has to take on such a adversaral position. Everyone has to share the pain. Although I believe the contract the FAs reached was somewhat unethical on both parts. ( The company agreeing to conditions they must have known they could not honor,and the union negiotiating a bonus in a contract for only some of the members) The judge is now the one who will decide what happens. At this point CUPE has lost any power they might have had. This is an example of smoke and mirrors for the members. They want them to believe they are actually able to do something on their behalf. They missed the boat err.... flight on this one.

What the company has stolen from us:

-loyalty bonus - this was only to be paid if CUPE could get its act together and merge the seniority lists. It didn't and therefore the bonus disappeared.

Pam has to realize soon that blaming everyone doesn't get the job done. Eventually you have to act like an adult, get to the table and at least save some of the jobs for your members. Unemployment is the alternative.

She's an idiot. When did some F/A's get the idea that they are highly trained skilled labor like pilot, maintenance, dispatchers, etc. How long does F/A training take?

Temporary .5% special assessment levy on union dues.

The Air Canada Component has an urgent need for funds to pay for the ongoing costs we will be incurring as a result of the Company’s CCAA filing.

The Need for More Specialized Resources

As we reported to you in Answering the Challenge Bulletin Issue 7, Volume 1, the Air Canada Component has retained a law firm as well as financial advisors to assist us with the CCAA process. CUPE is now being advised at every step of this process by legal counsel who specializes in insolvency, labour relations and pension law and by financial advisors who specialize in airline restructuring.

Koskie Minsky have successfully represented and advised us on the following matters:

1. Lay-offs: Halting the further 200 layoffs that were planned during the CCAA process.

2. Pension: Advising us on the best way to protect our pensions, including use of the court and other measures.

3. Collective Agreement: Winning a ruling that now prevents the Company from indiscriminately breaking our collective agreement.

4. Health and Safety: Maintaining our health and safety rights, and court dates have been set for the end of May 2003 to bring these issues before the Hon. Justice Farley.

5. Bargaining: Assisting us in bargaining preparation, and providing us with valuable support during the CCAA process

We have also hired ECLAT Consulting of Arlington, Virginia as financial and business plan advisors. ECLAT has extensive experience in airline restructuring in the US including Flight Attendants at United, Aloha and US Airways and other workers at US carriers, like American Airlines. They will assess the Company’s financial data and restructuring plan and advise CUPE on the viability of the plan as well as the implications for CUPE.

Why We Need Your Support

These new legal and financial advisor expenses for the month of April 2003 already exceed our incoming funds. This does not even take into consideration that the Air Canada Component also has many other expenditures including staff payroll, rent and the funding of all Component Committees.

Unfortunately, the Air Canada Component started off this CCAA process in a deficit position, as we were just exiting a year of extraordinary expenses because of the seniority arbitration and bargaining. The Air Canada Component has been diligently cutting costs including last month’s elimination of 2 full time staff positions at our Toronto office.

This means that we cannot pay for this required expertise and meet these new CCAA process related costs without a temporary levy from all members. We have requested $150,000 from the Airline Division, and a cost share campaign from CUPE National. In addition we will be seeking Court ordered reimbursement of these expenses. But until this assistance is available, we must have the resources to protect your rights. For this reason the following motion was unanimously passed at a Component Executive Committee conference call on May 2nd, 2003:

Whereas the Air Canada Component is presently in a deficit position after the extraordinary costs of the Burkett seniority arbitration and bargaining in the 2002 budget year, and

Whereas the Air Canada Component will be required to pay more extraordinary costs in 2003 due to the CCAA filings of the Company on April 1st, 2003

Be it hereby resolved that a temporary levy on union dues of 0.5% of gross earnings be deducted from all dues paying members of the Air Canada Component effective with the June 17th, 2003, paycheques, and

Be it further resolved that this temporary levy of 0.5% be collected for only the same number of months that the Company remains under CCAA, and

Be it further resolved that the Air Canada Component will credit the dues paying members of the Air Canada Component and amount of the .05% temporary levy that is not required to cover the legal and associated costs of the CCAA, and

Be it further resolved that this temporary levy will be subject to a membership vote that will take effect in May 2003.

Any excess funds received from members as a result of this temporary levy will be refunded to the members once this CCAA process is complete.
