The case dates back to last summer when the airline filed a judicial review to challenge and increase the 30 tarmac clots they were granted to fly out of the Island Airport by the port authority.On Tuesday, the federal high court dismissed Air Canada's claim and ordered it to pay court costs for the port authority and Porter. The use of the Island Airport has been a contentious one after Air Canada was originally barred from using the airport in 2004. In 2006, Porter Airlines was given exclusive rights to the site. If a big corporation tries to derail and distract a smaller one and diminish its capitals in legal fees to defend itself, it should be able to recover its costs which would also have the added benefit of deterring the bigger corporation in pursuing future unfounded claims.
