I wonder what provides Porter with more revenue? Their US routes or all the costs awards they have received from Air Canada over the last five years in Air Canada's ill-conceived pissing contest.

Porters chickens won't be coming in from the cold that soon.....Air Canada will be appealing the decision.

Air Canada plans to appeal court case

680News staff and The Canadian Press Jan 09, 2011 08:22:25 AM ONTARIO - Air Canada said it plans to appeal after being ordered to pay $2-million in court costs stemming from a fight with Porter Airlines.

The case dates back to last summer when the airline filed a judicial review to challenge and increase the 30 tarmac clots they were granted to fly out of the Island Airport by the port authority.

On Tuesday, the federal high court dismissed Air Canada's claim and ordered it to pay court costs for the port authority and Porter.

The use of the Island Airport has been a contentious one after Air Canada was originally barred from using the airport in 2004.

In 2006, Porter Airlines was given exclusive rights to the site.

Don't forget this is cost recovery for legal fees and taxes, and as such is not revenue. If a big corporation tries to derail and distract a smaller one and diminish its capitals in legal fees to defend itself, it should be able to recover its costs which would also have the added benefit of deterring the bigger corporation in pursuing future unfounded claims.
